TR to PR Pathway Now Offers Extended Work Permits.
Longer Open Work Permits for TR to PR Applicants
The Canadian government has extended its temporary policy that allows individuals applying through the TR to PR pathway to receive longer open work permits (OWPs) while their permanent resident applications are being processed. This is great news for those still in the process, as it gives them more time to work in Canada.
Family Members Can Benefit Too
Not only the applicants themselves but also their spouses, common-law partners, and dependent children can now apply for open work permits under this policy. This helps families stay together and work in Canada while waiting for the permanent residency decision.
Extension Until 2026
This policy has been extended until December 31, 2026, giving applicants more time to benefit from the extended work permits. Whether you are in the process now or are still waiting for your permanent residency, this extension provides crucial flexibility.
Eligibility for TR to PR Applicants
For those still in the PR process, here are the key eligibility criteria for applying for an additional work permit under this policy:
- Temporary Resident Status: You must have temporary resident status or be eligible to restore it.
- Work Permit Validity: If you currently hold a work permit, it must be valid for less than four months when applying for the OWP.
- Application Through IRCC: You must apply for an OWP through the IRCC’s secure account.
- Proof of Language and Work Authorization: Applicants need to prove they have legal work authorization and meet language test requirements.
- Acknowledgement of Receipt (AOR): You must have received an AOR from IRCC for your PR application, confirming it is within the policy’s cap.
Also your PR application cannot have been withdrawn or rejected before applying for the OWP.
Family Member Eligibility
Now, let’s talk about the eligibility for family members of the principal applicant to apply for a work permit. They must meet the following conditions:
- Work Permit Application: Family members must apply for the OWP through the IRCC secure account and include the principal applicant’s UCI (Unique Client Identifier).
- Family Relationship: Eligible family members include spouses, common-law partners, and dependent children of the principal applicant.
- Accompanying the Principal Applicant: Family members must have been included as part of the PR application.
- Age Requirement: Family members must be 18 or older when applying for the OWP.
- Temporary Resident Status: They must have valid temporary resident status or be eligible to restore it if applying from within Canada.
What Is Considered a Dependent Child?
For Canadian immigration, a dependent child is anyone under 22 who is unmarried and not in a common-law relationship. However, children over 22 may still qualify if they have been financially supported by their parents since before they turned 22 and are unable to support themselves due to a physical or mental condition.
Work Permit Fees
If you are applying for an open work permit under this policy, you will need to pay the processing fee, but the additional fee typically required for open work permit holders will be waived.
What Happens if a PR Application Is Rejected?
It’s important to note that if the principal applicant’s PR application is rejected, all related work permit applications will also be refused. Therefore, it’s essential to ensure that your PR application remains valid and under review.
Conclusion
The extension of this policy offers both applicants and their families valuable opportunities to continue working in Canada as they await their permanent residency status. So, if you are in this process, make sure to check your eligibility for the open work permit extension and enjoy the extra time it provides.
