New Agri-Food Immigration Pilot opening in early 2020, attracting workers from agriculture and agri-food industry

As a part of Canada’s economic immigration strategy, the pilot programs are launched in response to the needs of the labour market in Canada. With this new Agri-Food Immigration Pilot, Canada is seeking foreign workers who have worked in the agriculture and agri-food industry. It is expected to launch in early 2020.

These programs will not only address the labour shortages in Canada but also benefit the middle-class workers. The Pilot aims to provide workers with an opportunity to become permanent residents in Canada under this program.

The employers in the agri-food industry, interested in hiring workers under this program will be eligible for a 2-year Labour Market Impact Assessment (LMIA).

The occupations and industries which are eligible under this Pilot include:

  • meat processing
  • retail butcher
  • industrial butcher
  • food processing labourer
  • harvesting labourer for year-round mushroom production and greenhouse crop production
  • general farm worker for year-round mushroom production, greenhouse crop production, or livestock raising
  • farm supervisor and specialized livestock worker for meat processing, year-round mushroom production, greenhouse crop production or livestock raising

The eligibility requirements for this Pilot program includes: 

  • 12 months of full-time, non-seasonal Canadian work experience in the Temporary Foreign Worker Program in one of the eligible occupations.
  • a Canadian Language Benchmark level 4 in English or French
  • the foreign equivalent of a high school level education or greater
  • an indeterminate job offer for full-time, non-seasonal work in Canada, outside of Quebec, at or above the prevailing wage

As per the government, a maximum of 2,750 principal applicants will be accepted for processing every year, once the pilot opens next year.

First Tech Draw in Ontario is a highlight of this week-invited 1,623 Express Entry candidates

Under the Ontario Immigrant Nominee Program (OINP), the province of Ontario invited prospective newcomers under one of the Ontario’s Express Entry streams: Human Capital Priorities (HCP) stream.

On July 12, 2019, the targeted candidates with work experience in the following NOC codes: 

  • 2173   Software engineers and designers
  • 2174   Computer programmer and interactive media developers
  • 2147   Computer engineers
  • 2175   Web designers and developers
  • 2172   Database analysts and data administrators
  • 0213   Computer and information systems managers

The candidates with CRS score as low as 439 were invited. The scores ranging from 439 to 458 were the pick for the tech draw. A total of 1,623 candidates with work experience in the tech occupations were invited from the draw.

Under the new tech draws, the OINP will be filtering and finding a candidate from the Express Entry pool who may:

  • Satisfy the requirements under HCP stream
  • Have work experience in one of the targeted NOC codes

The candidate already in the pool may receive a Notification of Interest (NOI) to apply under the stream and achieve permanent residence in Canada.

The focus of the stream is to help ICT businesses to hire global talent from around the world. The Express Entry will not only provide a fast-track way to achieve permanent residence to the candidates but also meet the labour market needs.

Immigrating under OINP’s entrepreneur stream made easier for foreign business investors

The foreign business owners or senior managers, having business management experience in the past can apply to immigrate to Canada under the Entrepreneur Stream of Ontario Immigrant Nominee Program’s (OINP). Once the business is successfully established in the province of Ontario, entrepreneurs can become eligible to seek a nomination from the province.

The minimum requirements under the Entrepreneur stream have been updated recently, to make the stream more attractive to job creators.

Personal Investment and Net worth

The threshold of personal investment and net worth have been reduced with the recent regulatory amendments made in the program. The personal investment limit is reduced from $1 million to $600,000 in the Greater Toronto Area (GTA) and from $500,000 to $200,000 outside the GTA or in the information and communications technology or digital communications sector.

The net worth thresholds have also been reduced from $1,500,000 to $800,000 in the Greater Toronto Area (GTA) and from $800,000 to $400,000 outside the GTA or in the information and communications technology or digital communications sector.

Business experience 

The prospective applicant must have at least 24 months of full-time business experience in the last 60 months as a business owner or as a senior manager.

Requirements for the business 

The Entrepreneur Stream must also meet the general requirements to participate in the stream:

  • Purpose of the business: make a profit from active income through the sale of goods and/or services.
  • Compliance with regulations: must meet federal, provincial or municipal, regulatory or licensing requirements
  • Permanent business: must be a permanent project
  • Located in Ontario: the place of business must be in Ontario for all times
  • Third party investors: they must be Schedule I or Schedule II bank or an institutional investor

A strong business plan that can showcase the capacity of the business to flourish and grow in the next 5 years can be a way to proceed with an application under this category.

Computer Network Technicians added in the Global Talent Occupations updated list

Earlier this year, while addressing the talent shortage, the Global Talent stream (‘GTS’) was introduced permanently in March 2019. Significant changes were brought to make it easier for the high-tech skilled workers to move to and settle in Canada, in terms of processing of applications and issuing of new permits.

In the last 2 years, the Government of Canada has invited nearly 24,000 visas under the Global Talent Stream (GTS). The temporary foreign workers with work experience in the listed occupations under category B could obtain a work permit within a short processing time of 2 weeks.

The eligible occupations list has been updated with an addition, while Engineering managers and architecture and science managers under NOC 0211 and NOC 0212, respectively have been removed. The new addition of Computer Network Technicians is now in the eligible occupations list.

These changes are introduced in response to the labour demand of the market in Canada. The Canadian employers are looking to hire foreign workers, who can easily obtain a work permit within 2 weeks of processing time. The eligible applicants will also benefit from quick processing of Labour Market Impact Assessment applications.

Regarding deleted occupations, the applications will not be processed after August 4, 2019. The listed occupations are in the fields of Information Technology and Science, Technology, Engineering and Mathematics (STEM) with easier access to eligible temporary foreign workers who has the relevant experience in the field.

Truck drivers, and home support workers and related occupations added in the in-demand list under OINP

A call to all the hardworking truck drivers and home support workers to settle in Ontario by obtaining permanent residency which is offered with requirements easier than before. It is time to prepare for the process beforehand.

As announced earlier this year, the in-demand skills list has been amended today on July 8, 2019. Truck Drivers, and Home Support workers and related occupations, excluding housekeepers, are now included in the list of eligible occupations under the NOC head of 7511 and 4412, respectively. The applicant must have obtained a job offer for an employment position that has been approved by the director.

The new changes have simplified the program requirements. The Employer Job Offer: In-demand skills stream falls under the Ontario Immigrant Nominee Program, which provides an opportunity for foreign workers with a job offer in specific in-demand occupations.

The applicant must meet pre-requisite requirements which include, requirements in terms of a job offer, applicant and employer.

The application must be submitted online to be nominated by the Ontario government for permanent residence. This is open to foreign workers in and outside Canada.

Other eligible in-demand skills occupation falling under NOC C and D are as follows: 

3413 – Nurse aides, orderlies, and patient service associates

4412 – Home support workers and related occupations, excluding housekeepers

7441 – Residential and commercial installers and services

7511 – Transport truck driver

7521 – Heavy equipment operators (except crane)

7611 – Construction trades helpers and laborers

8431 – General farm workers

8432 – Nursery and greenhouse workers

8611 – Harvesting laborers

9462 – Industrial butchers and meat cutters, poultry preparers and related workers

New Pilot Programs Launched for Caregivers to Obtain Permanent Residency in Canada

The Government of Canada has paid substantial attention to the vulnerabilities of the caregivers working in Canada without finding any pathway to obtain permanent residence.

Interim Caregivers Program-Extended

The short-term interim pathway that began accepting applications in the month of March 4, 2019 until June 4, 2019, will re-open again for 3 months on July 8, 2019. This program requires:

  • Minimum language requirements of CLB 5 in English or French; and
  • work experience of 12 months in Canada in the relevant NOC code
  • Minimum education of high school diploma in Canada or ECA for foreign diploma, certificate or credential

 New Programs effective from July 18, 2019

There are two new programs that began accepting applications on June 18, 2019, which replaced the existing Caring for Children and Caring for People with High Medical Needs Pilots.

The new programs are Home Child Care Provider and Home Support Worker pilots, applying under which will provide a work permit to the caregivers. This is a 5-year pilot program with a goal to grant permanent residence to the qualifying candidates and their family members.

The caregivers must have a job offer in Canada and satisfy the minimum requirements of the program.

Qualifying Work Experience

  1. If you have 2 years of work experience: The 2 years of qualifying experience as a home care provider and home support worker, which falls under NOC 4411 and NOC 4412, respectively, will be eligible to apply for the permanent residency directly under one of these pilots.
  2. If you do not have any work experience: The pilot program provides an opportunity to submit an application for a work permit together with the application for permanent residence, if all other requirements are met. Once the applicant meets the work permit requirements, an occupation-specific open work permit is issued that will allow the caregiver to work any employer, as opposed to working for one employer, that was the case in the past. The applicant can gain 24 months of qualifying work experience to obtain permanent residence in Canada.
  3. If you have less than 24 months of experience: The pilot allows the applicant to apply under either of the two pilots, as long as the other eligibility requirements are met. The applicant can apply for a work permit along with the application to obtain permanent residence. Once the work experience is enough to qualify and proof of experience is sent, the application will be considered.

Non- qualifying work experience

  • Experience as a foster parent does not count, when counting experience under NOC 4411
  • Experience as a housekeeper does not count, when counting experience under NOC 4412

INTERNATIONAL EXPERIENCE CANADA PROGRAM: Live and work under the exchange program, benefiting Canadians and Luxembourg people

The Government of Canada signed a bilateral agreement with Luxembourg to facilitate youth mobility, while opening doors to gain international experience. The exchange program not only will allow Canadians and Luxembourgish youth to travel but also work in each other’s country for up to 12 months.

Under the International Experience Canada (IEC) program, there are three categories that can opt, including:

  • The working holiday: the applicants are provided with open work permits to allow them to work in any of the host countries, with secured financial support.
  • International Co-op (Internship): the applicants get an employer-specific work permit to allow them to gain exposure to their study discipline.
  • Young professionals: the applicants receive an employer-specific work permit to allow them to gain experience within their targeted field of study.

As per the Government of Canada, more than 200,000 Canadians have participated in the International Experience Canada program, and many have returned to Canada with life-changing experiences valuable to both their personal and professional lives.

Eligibility: 

The applicant can apply under the IEC program if:

  • Their country or territory of citizenship must have a bilateral agreement with Canada in order to obtain an IEC work permit
  • You can contact a Recognized Organization (RO) for help to plan your trip

Process: 

The process stages include creating a free online IEC profile, filling in the online forms, and submit it in the pool. The candidates in the pool will get invited and given 10 days to respond back to the invitation. If the invitation is accepted, the applicant will have 20 days to apply online for a work permit.

Employment and Labor law Jurisdiction:

All foreign nationals in Canada will fall under the purview of the employment and labor law standards. The wages standards will be according to the place where the applicant is working. In case of an internship, the labor code of the province or territory will determine whether it will be paid or not.

Sponsor Non-disclosed family members under the new two-year pilot program

According to the Section 117 (9) (d) of the Immigration and Refugee Protection Regulations (IRPR), the non-accompanying family members who were not declared by the sponsor at the time of applying for Canadian permanent residence and therefore, not examined by immigration authorities could never be sponsored by the sponsor.

The provision was strictly applied to all the cases without any discretion to consider the legitimate and serious reasons why applicants do not declare family members. This had a very disproportionate effect on vulnerable applicants.

The non-disclosed family members who were not accompanying had to face a lifetime ban to come to Canada as a sponsored person. The applicant/sponsor was charged for misrepresenting the government for not declaring their family members.

For those who were struck by this provision had only one option i.e. to seek an exemption under the Humanitarian and Compassionate (H&C) considerations under Section 25 of the IRPA. Having said that, the decisions made considering the H&C factors were not very qualitative.

As a result, many applicants had to suffer and live apart from family members.

“Today, we right that wrong,” said Immigration Minister Ahmed Hussein when announced the new pilot.

New Pilot Program

The Government of Canada is starting to run a pilot that will run from September 9, 2019, to September 9, 2020, plus the in-process applicants will get the benefit of the pilot.

IRCC defined sponsors covered by the pilot as resettled refugees, that conferred refugee protection in Canada or those who were themselves sponsored as a spouse, partner or dependent child.

Under this pilot, previously banned family members can be sponsored for the permanent residence. This will not only reunite family members who are suffering the agony of separation but also give them a chance to understand the effect of relaxing the strict provisions.

Addressing the harsh effects of Section 117(9)(d) of IRPR on children left behind, parents and families in Canada, impact on Children already in Canada, the pilot will now allow the sponsors to bring their family members to Canada.

He also announced that migrant workers who are facing abuse at workplaces due employer-specific permits can now apply for an open work permit, avoiding violence and harassment.
