Canada and India have come together and expanded their air transport agreement which means from having a total of 35 flights a week to now providing an unlimited number of flight transactions from India- Canada!

Yes, this is true! To strengthen the ties of the economy between the two countries, Omar Alghabra, the minister of transportation has announced the recent update of the expanded air transportation agreement between India and Canada which is the latest in Indian aviation news.

What is this agreement between India- Canada?

In this agreement between India and Canada, the airlines are allowed to fly an unlimited number of flights between the two countries. The Canadian government, in one of its statements, suggests that this tie will open up ample of opportunities for both countries with regards to businesses, students, investors, and families.

Looking at the figures, around 1.5 million people flew to Canada from India in the year 2019 which means the market to cater is huge and the 2 flag companies that will be benefited the most are Air India and Air Canada.

“The Canada-India economic relationship is built on deep-rooted people-to-people ties. With this expanded air transport agreement, we are facilitating even more exchanges of professionals, students, businesspeople, and investors. Based on this expression of interest a job offer from Saskatchewan could be expected. The International Healthcare Worker EOI provides the opportunity to link foreign-trained workers with Saskatchewan healthcare employers.

Saskatchewan Conducted the first ever draw of 2022 in the specialized field (Health Care Workers), these occupations were listed in the excluded list of Saskatchewan since the day when Saskatchewan changed its system of accepting applications for Provincial Nomination i.e., in September 2018 they introduced a new system of accepting applications for Provincial Nomination known as EOI and they published two occupations list:

 

1. Professional Requirements by Regulated Occupations (Some jobs in Saskatchewan are regulated or need professional certifications from the concerned authority.)

 

2. Excluded Occupation List (This is a list of occupations that are not eligible for these program sub-categories) (Which almost included all the medical occupations)

Saskatchewan conducted a draw on 12th January 2022 and issued 104 Invitations to all Express Entry as well Occupations in Demand Category applicants with the EOI Score of 68 and the occupations included in this draw were specific to International Health Care Workers. The occupations invited to apply for this draw are as mentioned below:

  • 3211 – Medical laboratory technologists
  • 3234 – Paramedical occupations
  • 4151 – Psychologists
  • 3216 – Medical sonographers
  • 3143 – Occupational therapists
  • 3215 – Medical radiation technologists

Saskatchewan invited all those candidates who have an EOI Score of 68 and whose occupation matches the above job titles.

What is Canada’s new NOC and how it will affect your chances of PR

Canada utilizes a system called the National Occupation Classification (NOC) to identify the amount of education and training required for various occupations and careers, so to put it in easy language, NOC Code determines which occupations are skilled, semi-skilled, and unskilled. Canada generally requires candidates possessing skilled work experience.

Currently, IRCC uses the NOC 2016 to determine the eligibility of occupation, and soon in November 2022, it will be reintroduced! The NOC is updated by the federal government every ten years.

This will allow the Immigration aspirants to understand the impacts on their application once these rectifications are introduced.

NEW CHANGES TO NOC SYSTEM

Alteration of Terminology

This new terminology is more precise as the NOC assesses not just the level of skills, but also the level of training, formal education, and experience required to enter an occupation including the responsibilities associated with it.

Change in Skill level Categories-

The next change here is an increase in the number of categories. The new NOC has 6 teer categories, while the current NOC structure has 4 skill levels. The change will bring a clear difference between employment requirements with TEER being Categorised.

The New TEERs are as follows-

TEER – 0
  • Management Jobs (require a degree)
TEER – 1
  • Completion of a university degree i.e., bachelor’s, master’s, or doctorate)
  • Experience in a specific occupation from TEER category 2 (when applicable)
TEER – 2
  • Completion of a post-secondary education program within two years at community college, institute of technology, or CÉGEP
  • Apprenticeship training within the span of 2 years
  • More than six months of on-the-job training, training courses, or specific work experience with some secondary school education
  • Several years of experience in a specific occupation from TEER category
TEER – 3
  • Completion of a post-secondary education program within two years at a community college, institute of technology, or CÉGEP
  • Apprenticeship training with experience of at least 2 years
  • More than six months of on-the-job training, training courses, or specific work experience with some secondary school education
  • Several years of experience in a specific occupation from TEER category 4 (when applicable)
TEER – 4
  • Completion of secondary school
  • Several weeks of on- training with any secondary school education
  • Several years of experience in a specific occupation from TEER category 5
TEER – 5
  • Short work demonstration and no formal educational requirements

Change in the Classification System

The change from a four-digit NOC code to a five-digit NOC code will be the third big change. The new code is more flexible than the previous system and allows to add-in new units if required.

The New 5-digit NOC Code is Defined as Follows:

  • The first digit represents the broad occupational category.
  • The second digit represents the TEER category.
  • The first two digits together represent the major group.
  • The first three digits represent the sub-major group.
  • The first four digits represent the minor group.
  • The full five digits represent the unit group or the occupation itself.

Along with these major changes there have been changes to the occupation themselves, the new NOC 2021 contains 516 occupations up from 500-unit groups in 2016. All in all, these changes are more reliable and will bring a lot of clarity to the system.

The key tip for SOP – When you have been asked to write a statement of purpose and present it to the admission committee, the most important thing to consider is accurate grammar, spelling, and sentence structure. Although there is no specific word count for the SOP, it is advisable to maintain a word count of 1200 to 1500 words.

Express Entry Draw – Immigrate as a Skilled Worker

A Point-based Canadian immigration regulatory system (IRCC) is an online immigration application system. It allows people to submit a profile to be selected as a skilled immigrant. Candidates with the highest rankings are invited to apply for PR.

Provincial Nominee Program (PNP)

The Provincial Nominee Program allows different provinces across Canada to select Immigrants all over the world depending on their education, work, and skill and to work in Canada depending on the economy and the labor needs. An applicant who wants to become a Permanent Resident of Canada can apply to the different provinces as per their respective requirements.

  • There are two ways to apply – An online or a Paper-based application.

The number of applications issued by IRCC has increased from 1 million in 2011 to 2 million in 2020; dealing with such a caseload stresses officials at IRCC, and due to this, they have also encountered a high refusal rate of 54% in the year 2022.

Due to many qualified students receiving refusals, they intent to seek recourse in federal Court for unreasonable refusal for their application, this led IRCC to disclose the never-before-introduced tool used for processing applications named “Chinook”

What is Chinook?

Chinook is an Excel-based tool and not an AI (“big debates around Chinook is whether it is Artificial Intelligence!), in-house by IRCC to allow visa officers to review bulk applications, Chinook scans your application, looks for the keyword and gives red flag to certain keywords which may have result into refusal.

Even when you apply for a multiple-page explanation letter that states the intention of your visit or your statement of purpose (SOP) for a study visa, these applications are scanned through a system that makes the work of an Immigration officer much easier.

But the more we learn on how this efficiency-enhancing tool operates, the more we are concerned about the effect on its results. This question arises because the spreadsheet created by Visa officers allows them to review up to 1000 applications at the same time, and the visa officers could make notes as they review files simultaneously. There are chances that their notes may not be transferred back to GCSM system as the excel sheets will be deleted at the end of the session, which means you will not be able to know or refer the specific pointer jotted at the time of the assessment/review was made which might have been the actual reason for the Refusal.

IRCC is being challenged with a backlog that stands at 1.8 million applications as of February 1 and increased its target to 432,000 immigrants. Therefore, preparing a strong application will put you ahead in the game and will prevent your application from being reviewed. Due to this officer will think twice before refusing an application as they will be prepared thoroughly.

Automated processing of some categories of applications is not new. The Triaged model automatically approved low-risk online temporary resident visa applications. Visa applications were sorted into tiers – the lowest risk for auto-approval and medium-high risk for officer review. This triage model was deployed for all applications from China in 2018, and in the same year was piloted in India. The goal is for artificial intelligence to automatically approve low-risk applications, with officers only manually assessing those that have been flagged as a medium to high risk.

The concern for applicants and their counsel is for IRCC to develop a tool that allows the decision-maker to make a reasonable decision.

The Supreme Court in Minister of Citizenship and Immigration has asked at minimum that such tools must have the following characteristics –

  1. Oversight and checks built into the system to prevent errors.
  2. Necessary time and resources/training to review the application and decide on the evidence they get.
  3. Clear and accessible guidance on parameters for decision-making so that applicants are aware of the test to be made when submitting the application.

IRCC should be commended for attempting to develop tools to assist in the processing of applications. However, processing tools should be developed with input from key stakeholders and the goals of fairness.
